General sales and delivery conditions – nooosugar.nl
1. General
1.1 noosugar.nl is the trading name for nooosugar.nl v.o.f. (commercial partnership), registered with the Chamber of Commerce under number 34290904. These General Conditions apply to all offers, orders and agreements made by nooosugar.nl with her clients, the buyers of her products via the internet.
1.2 By using the nooosugar.nl internet site and/or placing an order the client agrees to accept these General Conditions.
1.3 The conditions can be downloaded via nooosugar.nl and saved. At the request of a client the Conditions will be sent per e-mail or per post.
1.4 Any (purchase) conditions stipulated by the client will be explicitly rejected.
1.5 Any deviations from these General Conditions must be specified in writing. In that case all the other stipulations in these Conditions will remain in full force.
1.6 All rights and claims, as stipulated in these General Conditions and any further possible agreements that are negotiated on behalf of nooosugar nl, will also apply equally to any intermediaries or other third parties that may be involved on behalf of nooosugar.nl.
1.7 If, by means of a legal verdict, or a binding verdict from any other authorized institution, one of the articles in these Conditions is declared invalid, all the other stipulations in these Conditions will remain valid.
2. Establishment
2.1 All offers made by nooosugar.nl are free of obligations.
2.2. An agreement exists at the moment when an order confirmation by nooosugar.nl on the internet is sent to the client. nooosugar.nl has the right to refuse orders, or to request additional information. If an order is not accepted, the client will be notified of the reasons by e-mail. If the order can only be carried out under different conditions, the client has the right to cancel the order with no further costs to the client.
3. Prices and payments
3.1 The prices quoted for the articles and services offered are in Euros, inclusive of V.A.T., and exclusive of handling and delivery costs, any possible tax or other charges, unless otherwise stated or agreed in writing.
3.2. The client must pay by using one of the payment options offered during the order process. The order could be subject to further (payment or delivery) conditions. For payments made by bank or giro the date of payment is the date on which the money is paid into the nooosugar.nl bank account.
3.3. The client agrees that nooosugar.nl shall take all the necessary actions to facilitate the method of payment chosen by the client.
3.4. noosugar.nl can not be tied to prices that are clearly incorrect, for instance due to obvious faults in layout or typing. No rights can be accredited to incorrect price information.
4. Supply
4.1. The nooosugar.nl products are handmade and imported from various different countries. The (delivery) terms stated by nooosugar.nl are approximate, and are determined on the basis of the information and circumstances which were known to nooosugar.nl at the time of the agreement. The delivery terms that are stated can never be taken as final terms.
4.2.If a change in the information and/or circumstances, whether or not this could be expected, causes a delay, the delivery date will be delayed accordingly. If goods are not delivered in time, nooosugar.nl must be held liable in writing, offering nooosugar.nl a reasonable time within which to deliver.
4.3. Exceeding the delivery time stated by nooosugar.nl, for whatever reason, does not at any time give the client the right to damages or to waive any of his/her obligations according to the agreement in question or any other related agreement.
4.4. If the approximate delivery time is exceeded by more than 14 days, the client has the right to terminate the agreement with no costs involved. In this case the client must notify nooosugar.nl by e-mail, fax or letter. Any payment that has been made in such cases will be refunded to the client within 30 working days after notification.
5. Delivery
5.1. The delivery costs will be automatically calculated by the nooosugar.nl internet shop. The packages will be delivered by TNT. If a package can not be delivered to a client, TNT will leave a message for the client. The client can then collect the package within 3 weeks from a nearby post office. If the period during which the client can collect the package has expired, the package will automatically be sent back to nooosugar.nl. If, after this period, the client wishes to have the package sent again, extra administration and delivery costs will be charged, and these must be paid in advance. The packages sent by noosugar.nl have a bar code, which implies that the entire delivery traject can be followed all the way to the door of the addressee. If a delivery is considered to be lost, TNT will carry out an investigation. If this investigation shows that a package has been delivered to the given address, the package will no longer be considered to be lost.
6. Intellectual and industrial ownership rights
6.1. All intellectual and industrial ownership rights pertaining to articles delivered by nooosugar.nl must be totally and unconditionally respected by the client.
7. Checking, repeal rights and claims
7.1. Immediately after receipt, the client must check the product for completeness and any obvious faults. Small irregularities and slight differences in colour and shape do not count as faults, since the products are handmade.
7.2. For agreements made via the internet site or in any other way in which only electronic communication has been used, the client has the right to repeal without incurring any penalty or giving any reasons.
7.3. If the client wishes to claim the right to repeal, (s)he has the right to return the product within a period of seven (7) working days and to terminate the agreement. Return deliveries will only be accepted if the return procedure described in Article 8 is strictly adhered to. The purchase price will then be refunded by nooosugar.nl within a maxim period of thirty (30) days. The direct costs for returning the product are for the client´s account.
7.4. During a period of seven (7) working days the client has the right to exchange the product for the same product in a different size or colour. Return deliveries will only be accepted if the return procedure described in Article 8 is strictly adhered to. The direct costs for return delivery are for the client´s account.
7.5. nooosugar.nl must be informed in writing, stating the reasons, about any faults in an article within a maximum period of two months after discovery. If it can be proved that an article does not meet the conditions of the agreement, after the return delivery nooosugar.nl has the choice, according to the procedure described in Article 8, to replace the article with a new one or to refund the purchase price plus the cost of the return delivery. If there is an evident fault, nooosugar.nl will refund the cost of the return delivery.
8. Procedure for returning products
8.1. In all cases when a product is returned, the article sent back by the client must be in the original, unused and unworn condition with all the original stickers and labels still attached, and in the original packaging. If the returned article does not meet these requirements it will be returned to the buyer cash on delivery.
8.2.When returning a product the client must adhere to the following procedure:
1. Send an e-mail to info@nooosugar.nl within seven (7) working days after delivery of the article.
State in the e-mail the reason for returning the article, the order number and, if applicable,
the new size or colour required.
2. You will then receive an e-mail from us with your return number.
3. Write your return number on your pro-forma invoice, which is enclosed with your purchase.
4. Tick the box on the pro-forma invoice for the article that you wish to return.
5. Put the pro-forma return form and the article in the original packaging, including, if applicable, the acompanying
black/white nooosugar.nl cover and protective filling material. Seal the box securely with sellotape.
6. Send the package within 5 days after receipt of your return number to the following address:
Nooosugar.nl, Postbus 20628, 1001 NP Amsterdam, The Netherlands.
7. Take the package to the post office. You pay the postage yourself.
9. Liability / force majeure
9.1. nooosugar.nl is not liable for misunderstandings, damages, delays, or improper transferral of orders and information due to the use of internet or other methods of communication between the client and nooosugar.nl, or between nooosugar.nl and third parties, unless there is proof of intent or serious negligence on the part of nooosugar.nl.
9.2.If compliance is impossible, because the ordered article is not available, nooosugar.nl will notify the buyer as soon as possible, and the client has the right to a refund of the amount paid by him/her to nooosugar.nl, with no extra costs. The refund will be made as soon as possible, and in any case within thirty days of the notification.
10. Applicable legislation and competent court
10.1. These General Conditions and all rights, obligations, offers, deliveries and agreements to which these General Conditions apply are subject only to legislation in the Netherlands.
10.2. All disagreements between parties will be resolved solely by the competent court in the Netherlands.
